If one were to ask franchisors what their top priority is, odds are that the overwhelming response would be to grow their franchise network with qualified franchisees. Yet, a number of franchisors continue to place a major roadblock on the road to achieving their objective. My opinion is based upon personal experience regarding how difficult it is to connect with a live person in many franchisor headquarters. For a number of years, businesses including franchisors, have replaced the position of receptionist with an automated contact system. Unfortunately, when pressing the number for the franchise department the response is often voice mail. I’ve even received the message: “The franchise department is closed” without instructions for leaving a voice mail.

When considering a franchise opportunity, one of the most important items, a prospective franchisee should review is the disclosed litigation between a franchisor and its franchisees. Presented in Item 3 of the Franchise Disclosure Document, this component of the due diligence process has been recommended by franchise attorneys and franchise industry professionals for countless years. There is little doubt that the amount and type of litigation a franchisor disclosed in their FDD can provide insight into the state and quality of franchise relations in a franchise system. However, what it doesn’t reveal is the amount of litigation that’s avoided due to a franchisor and franchisee amicably resolving their differences.

In my experiences I’ve had the opportunity to observe a number of franchisee startups in several different franchise systems. One conclusion I drew from this experience was how important the first ninety days are to a franchisee startup. An important factor to this time period is the amount of support the franchisor provides to a new franchisee. When evaluating a franchise opportunity, a prospective franchisee needs to include the amount of services and support they can expect to receive during their grand opening and startup phase, on their checklist. This includes sample press releases, marketing materials, advertising support and on-site assistance.
